Welcome to Medhasty.com (the “Website”). These Terms and Conditions (“Terms”) govern your use of our Website and the medical billing, credentialing, and revenue cycle management services provided by Medhasty Billing Services (“Company,” “we,” “us”).
By accessing this Website, completing a “Free Billing Audit” form, or signing a Service Agreement with us, you agree to be bound by these Terms.

1. Services Overview

Medhasty provides medical billing, coding, denial management, credentialing, and analytics reporting to healthcare providers ("Providers"). Services are formally activated only upon execution of a separate Business Associate Agreement (BAA) and Service Level Agreement (SLA) .

2. Not Medical Advice or Legal Advice

The content on this Website (including blogs, FAQs, and guides) is for informational purposes only. It does not constitute medical advice, legal advice, or a substitute for professional payer guidance. You should consult with qualified legal counsel regarding HIPAA compliance or payer contracts.

3. User Eligibility

By using this Site, you represent that: You are a healthcare provider, practice manager, or authorized representative of a medical practice. You are at least 18 years old. You have the authority to bind your practice to these Terms.

4. Free Billing Audit & Consultations

When you submit a form ("Request Your Free Billing Audit") or book a consultation: You consent to being contacted via phone, email, or SMS regarding your inquiry. Providing inaccurate information (e.g., fake phone numbers) may result in termination of the consultation. The audit is a preliminary review; actual results may vary based on full data access.

5. Fees and Payment Terms

Percentage-Based Models: For clients on a percentage-of-collections plan, fees are deducted from reimbursements before monthly remittance. Flat-Fee Models: Invoices are due net-15 unless otherwise specified in your contract. No Hidden Fees: As stated on our Site, we do not charge surprise add-on fees. Any changes to pricing require 30 days written notice. Collections: Past-due accounts may be subject to late fees (1.5% monthly) and suspension of claim submissions.

6. Client Responsibilities

To utilize Medhasty's services effectively, you agree to: Provide timely access to encounter forms, superbills, or EHR data. Notify us of provider additions, terminations, or payer contract changes. Maintain your own internal HIPAA compliance for patient intake. Do not submit claims directly to payers if Medhasty is managing your RCM (dual submission causes denials).

7. Intellectual Property

All content on this Website—including text, graphics, logos (Medhasty), and blog articles—is the property of Medhasty Billing Services and is protected by US copyright laws. You may not reproduce, distribute, or create derivative works without written permission.

8. Limitation of Liability

To the maximum extent permitted by law: Medhasty shall not be liable for indirect, incidental, or consequential damages (e.g., lost revenue due to payer-specific delays, software outages at your EHR vendor, or Medicare MAC changes). Our total liability for any claim arising from billing services shall not exceed the total fees paid by you to us in the three (3) months preceding the claim.

9. Disclaimer of Warranties

The Website and Services are provided "AS IS." While we aim for a 99%+ first-pass acceptance rate, we do not guarantee that every claim will be paid, as payers (insurance companies) ultimately control adjudication.

10. No Long-Term Contracts

As advertised, we do not require long-term lock-ins. Either party may terminate the Service Agreement with 30 days written notice. Upon termination, we will provide a final AR report and return all practice data in standard CSV/Excel format.

11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Maryland (Howard County). Any disputes arising from these Terms or Services shall first be attempted to be resolved via informal negotiation. If unresolved, disputes shall be submitted to binding arbitration in Columbia, Maryland, rather than court, unless the claim qualifies for small claims court.

12. Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, cyberattacks on clearinghouses (Change Healthcare style events), payer system outages, or pandemics.

13. Modifications

We reserve the right to update these Terms. Material changes will be notified via email to active clients or via a banner on the homepage.
